Every Victory Matters Kilo Delta LLC v. Bristol Women's Health LC

Our Senior Associate Laura Hecht-Felella and co-counsel Alexis Tahinci recently won dismissal of a lawsuit seeking to evict an abortion clinic in Virginia. The landlord of the clinic tried to rescind the clinic’s lease, alleging fraud because he claims he didn’t know they were providing abortions (which he says he is morally opposed to). The judge dismissed the lawsuit because the landlord knew or should have known what types of services clinics provide. However, the fight isn’t over – the judge still has to rule on a counterclaim for an injunction to keep the clinic from being evicted. If the clinic were to shutter, it would have devastating consequences for women who’d not be able to get services for miles. 

More Recent Victories

  • We recently had the honor and privilege of representing an undergrad woman in a campus disciplinary case where she was too intoxicated to consent to intercourse. The offender insisted that he, too, was intoxicated. Ultimately, we were able to prove that the offender was sober the next morning when he again had sexual contact without our client’s permission. The offender was disciplined as a result. Great work to Partner Aaron Stark on this difficult case! 

  • In our “Right to Forgive” case (Foy v Florida) – the First Amendment case about love – with co-counsel Randazza Legal Group and Andrew Greenlee, the court granted our motion for preliminary injunction, allowing Ms. Foy to communicate with her son. This is our case where our client is an elderly woman who just wants to be reunited with her son after he served time and rehabilitated for a violent crime against her. Although the judge isn’t allowing in person contact, he is allowing remote contact. Alongside co-counsel Marc Randazza and Andrew Greenlee, lead counsels from C.A. Goldberg were Carrie Goldberg and Roxanne Rimonte.

  • A triumph for abortion protectors was achieved in the Court of Appeals of Tennessee by Senior Associate Laura Hecht-Felella! The appeal concerned anti-abortion activists weaponizing domestic violence orders of protection to try to go after volunteers at clinics who are there to protect patients from the onslaught of harassment they face by protestors. One protestor who basically made it her job to intimidate and harass patients outside clinics sued our four clients for orders of protections. When the protestor lost, she appealed and was funded by anti-abortion fanatics. Co-counsel Alexis Tahinci and Laura powerfully argued the case with Laura focusing on our clients’ first amendment right to counterprotest. On March 28, 2024, the appellate court affirmed the trial court’s denial of the petition. This is a huge victory!  



  • Eight years after filing a complaint with the US Department of Education Office of Civil Rights, we got a victory for our client! At age 15, our client was filmed without permission engaging in a sexual act at a party in her Indiana hometown. The image was spread around her community and the local news showed up at the school to cover the “sexting scandal.” Rather than helping her, school admins opined that the offenders may have the right to free speech. Mind you, this was Child Sexual Abuse Materials (CSAM). Our client was bullied and shamed, and ultimately switched schools. As if this wasn’t bad enough, the yearbook published a spread about the shame they faced as a school, titling it ‘From Promiscuous to Infamous.”  Two presidential administrations later, we got the verdict that indeed our client was discriminated and retaliated against.
