If you think you may have had a nonconsensual pelvic exam

If you or a loved one think you may have had a nonconsensual pelvic exam at a NYC hospital, you may be able to recover damages.

C.A. Goldberg, PLLC is now receiving and investigating claims on behalf of people who had unnecessary and nonconsensual pelvic exams conducted on them at New York teaching hospitals.

If you had gynecological surgery at an NY teaching hospital there is a chance that after anesthesia was administered, your genitals were used by medical students to ‘learn how to perform a pelvic exam’ (according to our research, the practice of nonconsensual pelvic exams happens most often during hysterectomy procedures).

Everybody deserves to know what will happen to them during a medical procedure. Pelvic exams are among the most intimate medical procedures for a woman under ordinary conditions. Pelvic exams performed without consent is sexual assault. According to a report by the American Journal of Obstetrics and Gynecology, 90 percent of medical students performed a pelvic exam on an anesthetized women and most didn’t know if she’d given consent. [1] Among gynecologic surgery patients, 75% had had a pelvic examination under anesthesia performed by a medical student without prior discussion or approval, another national study indicates.2,3

Nonconsensual pelvic exams = school-sanctioned sexual assault.

Besides being deeply invasive and unethical, the practice of conducting medically unnecessary pelvic exams on incapacitated individuals has been disregarded by experts as an ineffective teaching method. Yet it persists, driven by doctors who seem to believe that they have absolute privileges over an individual entrusted to their care.

“The practice of performing pelvic examinations on unconscious persons is widespread and common throughout the US. Many medical students have confessed to performing these exams under the guidance of senior physicians, and often report feelings of shame and guilt over something that seems so unethical. A study from 2003 found that 90% of the medical students polled had performed pelvic exams on anesthetized women.” NY senate website link

There are likely thousands of women in New York and indeed across the USA who were violated at hospitals through the routine performance of unnecessary pelvic exams.

Frequently Asked Questions:

In 2019, the APGO officially recommended that medical students perform pelvic exams only if:

  1. There is explicit consent
  2. The pelvic exam is related to the procedure
  3. The patient recognizes the student as part of the care team
  4. The exam is performed under supervision

While on one hand we acknowledge that this is progress, it’s also extremely disturbing to consider that this is only just being recommended.

Most people who received unnecessary pelvic exams notice no observable evidence of it, especially if they were receiving surgery in the pelvic region.
